A Last Will and Testament is the foundation of a simple estate plan. By having your will designed and drafted by one of our qualified and experienced estate planning attorneys you can ensure that your wishes and desires are carried out after your passing.

By drafting a will you can control how your property is administered after your death. This takes away the reliance on mere chance or the state intestate laws to hope your property is handled the way you wish. It can also limit fights that the family may have as your desires and wishes are written out for them to follow.

The major advantage to having your will drafted is that you will avoid what is called intestate. This is the term used when a person dies without a will. The laws of intestate then decided where your property will go and how your estate will be administered in the probate court. Many people are surprised to learn that the laws of intestate do not pass their property in a way that matches their desires. For instance, not all property automatically goes to the surviving spouse under the intestate laws as some of the property is given to surviving children instead.

Secondly, the properly drafted will can help you leave a legacy to those people that would not have received anything had you not had a will and left your property through the intestate laws. This can include a charity, a friend, a church, a university, etc.

Somethings to keep in mind when contemplating a will based estate plan: A will does not avoid probate, thus with large estates it may lead to a costly probate case. When passing through probate the will and the estate become part of the public record and thus there is little privacy for the family. Most importantly, a will alone without additional planning does not help you to plan for disability or incapacity as it only takes effect upon your death.
